1. Agreement to Terms

These Terms and Conditions (“Terms”) form a legally binding agreement between you (“Customer,” “you,” or “your”) and Crown Forged, doing business as Crown Forged, a North Carolina–registered business (“Crown Forged,” “we,” “us,” or “our”), governing your access to and use of www.crownforged.com (the “Site”) and all purchases, orders, and communications made through it.

By accessing the Site, submitting an order, or checking the box during checkout, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of the Site immediately.

We may update these Terms periodically. Material changes will be announced on this page or via email at least 7 days before taking effect. Continued use of the Site after such updates constitutes acceptance of the revised Terms.

Electronic Communications:
By using the Site or contacting us, you consent to receive notices, updates, and communications electronically. These satisfy all legal notice requirements.

2. Intellectual Property

All website content—including designs, photographs, text, graphics, videos, and trademarks—is the exclusive property of Crown Forged or its licensors. You may not reproduce, distribute, or use any content for commercial purposes without written permission. Personal use for non-commercial reference is allowed.

If you submit designs, photos, or creative concepts for custom work, you grant Crown Forged a non-exclusive, royalty-free license to use and reproduce that material solely to fulfill your order and for internal or portfolio documentation. Public use for marketing will only occur with your consent.

You represent that any submitted material does not infringe the rights of any third party.

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). To report infringement, contact jeff@crownforged.com with details per 17 U.S.C. § 512.

3. User Eligibility & Conduct

You must be at least 18 years old or the age of majority in your jurisdiction to use this Site or place an order.

You agree not to misuse the Site, including but not limited to:

  • Accessing restricted areas, systems, or data without authorization

  • Copying, scraping, or reverse-engineering the Site

  • Uploading malicious code or interfering with normal operation

  • Impersonating another individual or business

  • Using the Site to harass, defraud, or misrepresent information

We reserve the right to refuse service for legitimate business reasons—such as policy violations, risk concerns, or resource limits—while complying with all applicable anti-discrimination laws.

4. Orders, Custom Work, and Pricing

All jewelry and engraving work by Crown Forged is handcrafted. Prices and materials may fluctuate based on current metal markets, gemstone supply, and design complexity.

Design Fees, Deposits, and Approvals

  • For projects requiring CAD design work, a $100 CAD design fee is collected before any modeling begins. This fee covers design time and is non-refundable, but will be credited toward the final purchase price if the project proceeds.

  • A deposit of approximately 50 % of the quoted total is required to begin production once the design is approved.

  • Deposits are refundable within 48 hours of order confirmation only if no engraving, casting, or fabrication work has begun.

  • Once engraving, casting, or any bench work has started, the deposit becomes non-refundable, as the work performed and materials used cannot be reversed or resold.

  • All design proofs or revisions must be approved in writing before engraving, casting, or fabrication begins.

Payments and Taxes

We accept secure online payments (processed through PCI-compliant systems). Prices are in U.S. Dollars (USD). Customers are responsible for applicable sales tax, duties, and import fees.

Ethical and Legal Standards

We reserve the right to decline designs that promote hate, violence, or illegal activity.

5. Shipping, Insurance & Risk of Loss

All outgoing shipments are insured through a carrier chosen by Crown Forged.
Insurance and shipping costs are included or itemized on your invoice.

  • Once a package is scanned and marked as “Delivered” by the carrier, responsibility transfers to the customer.

  • Customers must use insured, trackable shipping when sending items for engraving, repairs, or custom work.

  • Insurance covers the declared or appraised value of the item at the time of shipment.

  • Crown Forged is not responsible for loss or damage caused by carrier mishandling, improper packaging, or uninsurable materials.

Shipping Timelines:
Typical delivery is 3–5 business days after completion. Delays due to carriers, weather, or customs are beyond our control.

International Orders:
Customers outside the U.S. are responsible for all customs duties, import fees, and local taxes. Delivery times and insurance coverage vary by region.

6. Refunds, Returns & Repairs

Because each piece is handcrafted, all sales of custom, engraved, or made-to-order items are final.

Defects and Workmanship:

  • Report defects within 30 days of delivery for evaluation.

  • “Defect” refers to a flaw in craftsmanship or materials—not normal wear, minor variation, or damage from use.

  • Approved cases may be repaired or replaced at our discretion within a reasonable timeframe.

Stock Items:
Non-custom, non-engraved stock items may be returned within 14 days of delivery for store credit, provided they are unworn and in original condition.

Chargebacks and Disputes:
You agree to contact Crown Forged directly before filing a chargeback. Unauthorized disputes may incur recovery and administrative fees.

7. Privacy & Data

Your data is handled in accordance with our Privacy Policy.
We implement reasonable security measures to protect your information but cannot guarantee absolute security against breaches beyond our control.

If you reside outside the United States, you consent to the transfer and processing of your data within the U.S.
For access, deletion, or correction requests, please refer to our Privacy Policy.

8. Site Management & Modifications

We may modify, update, or remove content, pricing, or availability on the Site at any time without notice.
Pricing changes apply only to new orders; confirmed custom orders are locked at the agreed quoted rate.

Links to third-party websites are provided for convenience. We are not responsible for their content, privacy policies, or actions.

9. Disclaimer & Limitation of Liability

The Site and all products are provided “as is” and “as available.”
While we take great pride in our craftsmanship, Crown Forged does not warrant uninterrupted service, exact duplication of natural materials, or future durability of jewelry under normal wear.

To the fullest extent permitted by law:

  • Crown Forged and its representatives are not liable for indirect, incidental, or consequential damages, including lost profits or data.

  • Our total liability for any claim shall not exceed the purchase price of the specific item in dispute, or $100—whichever is greater.

  • Exclusions do not apply to cases of gross negligence, fraud, or willful misconduct.

Some jurisdictions restrict these limitations; where applicable, they apply only to the extent allowed by law.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflicts of law.

Informal Resolution:
Before arbitration, both parties agree to attempt good-faith negotiation for 30 days.

Binding Arbitration:
Unresolved disputes will be settled through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Rules.
Arbitration may occur virtually or in Henderson County, North Carolina.

Class Action Waiver:
All disputes must be brought individually. Class or collective actions are expressly waived.

Attorney Fees:
The prevailing party in arbitration may recover reasonable attorney fees and costs.

11. Trade Accounts (B2B Addendum)

Crown Forged offers services to verified jewelers and trade partners under separate B2B agreements.
These Terms apply only where not superseded by a signed trade agreement.
Trade clients are responsible for maintaining their own primary shipping insurance for all shipments.

12. General Provisions

Force Majeure:
Crown Forged is not liable for delays or failures caused by events beyond our control, including natural disasters, supply shortages, or carrier issues.

Severability:
If any provision of these Terms is found invalid, the remaining provisions remain enforceable.

Waiver:
Failure to enforce any term does not constitute a waiver of rights.

Entire Agreement:
These Terms, together with our Privacy Policy and your order confirmation, constitute the complete agreement between you and Crown Forged.

Assignment:
We may assign these Terms to successors or affiliates. You may not assign them without our written consent.

Export & International Compliance:
You agree not to export or use our products in violation of U.S. laws or international regulations.

Accessibility:
We strive to maintain an accessible and inclusive online experience but make no warranties regarding compatibility with assistive technologies.

International Use:
You are responsible for complying with local laws when accessing or purchasing from outside the U.S.
